INTERPRETATIONS:
In these conditions, “The Company” means Vicol Supplies, which is a trading name of EKM Services Ltd. registered in England. Company registration 5006141
PAYMENT:

In the event of non-payment we reserve the right to claim all costs if it is necessary to recover outstanding debts, which exceed our stated terms, whether through the courts, or otherwise and to charge interest on the outstanding balance at 3% p.a. above bank rate from the date the debt becomes overdue.
PRICES:
Prices quoted are subject to VAT, unless otherwise stated. They are subject to alteration without notice and the prices at which goods are invoiced will be the price ruling on the date of despatch.
OWNERSHIP:
The ownership of goods supplied shall not pass to the purchaser (and on receipt the Purchaser shall keep the goods as bailee and trustee of The Company returning them on demand) until the invoiced price of the goods shall be wholly paid and until any other previous sums whatsoever which are due from the purchaser to The Company have been paid in full without any reduction or deferment on account of any dispute or cross-claims whatsoever. Nevertheless the risk shall pass to the purchaser immediately the goods are delivered to him.
DELIVERY TIME:
Any date or period for delivery stated by The Company is given as an estimate only and is not binding on “The Company”.
For larger commercial cleaning machines these are either delivered direct from the manufacturer to client site or to Vicol Supplies who will carry out a pre-delivery inspection and test operation to ensure everything is satisfactory and will record the serial number for warranty purposes. The machine(s) plus any accessories and chemicals ordered will then either be delivered and installed directly by Vicol engineers or directly to client.
Subject to manufacturers stock availability, delivery of larger commercial cleaning machine may be between 5 - 10 working days. Where possible we will keep you advised upon delivery or installation dates for your particular machine.
DAMAGE OR LOSS:
In the event of partial damage or loss, a claim on the carriers and The Company must be made in writing within 3 days of delivery. Non-delivery must be notified to The Company within 14 days of date of order and/or invoice.
RETURNS:
Items correctly supplied against an order may not be returned for credit without prior agreement from The Company. Provided the Goods are returned unused in the original packaging we will refund the full cost less the delivery or carriage cost. Otherwise we reserve the right to make a percentage charge for restocking of 15% of the original invoice value. Payment of any restocking value must be paid prior to the good being returned.
PRODUCT DATA SHEETS:
These are available to cover various products supplied via our web-shop and can normally be downloaded directly. In the event a data sheet is not available from the web-shop these are available from our office and can be obtained by emailing office@vicol.co.uk. USAGE:
All products supplied by The Company are supplied and provided on the condition that we cannot be held responsible in the event they are used for any other purpose than that specified by the manufacturer. Any recommendations and advice offered are given without legal responsibility and are based solely on the information received from the purchaser. The Company shall not be liable to the customer in the event of; damage to goods or injury to persons resulting from negligent or improper use or handling of goods by the customer, their employees or their agents or members of the general public, or any loss of profit or contracts or other consequential losses of any kind contingent upon any acts or omissions of The Company or its agents however caused.
CANCELLATION RIGHTS:
You have the right to cancel your order at any time up to 7 working days of receiving your products without giving a reason providing the goods are unused, in original packaging and in a re-saleable condition. Such notice of cancellation must be in writing quoting your order reference. Provided the Goods are returned unused in the original packaging we will refund the full cost less the carriage cost. Otherwise we reserve the right to make a percentage charge for restocking of 15% of the original invoice value. Payment of any restocking value must be paid prior to the good being returned. In such event, The Company will issue a credit to you, for the balance of the original value of the goods being returned less the costs of return shipping and less restocking charge. The Company will refund any monies due within 30 days of the goods being returned to us and being confirmed as re-saleable and in their original packaging. Any goods returned which are not in their original packaging or are not re-saleable will not be credited. You have the right to cancel your order prior to receiving your goods and such cancellation must be in writing. The company shall confirm that your order has been cancelled in writing to you and refund any payments made within 30 days of receiving your cancellation. For orders cancelled prior to delivery of the goods there is an adminstration charge of £45. The administration charge will be deducted from any refund applying. For cancelled orders under £300, where payment of the original order was by credit or debit card the company shall refund any monies due back to the original card used at the time of ordering. For cancelled orders over £300, where payment of the original order was by credit or debit card the company shall refund any monies due back to the customer either by cheque or BACS payment. This section has been introduced to incorporate the new European Directive on distance selling which is incorporated into UK law by The Consumer Protection (Distance Selling) Regulations 2000.
